Terms of Service

1. Who we are

İhaleOn (the “Service”) is operated by Kreatif Technology LLC (“we”, “us”), a limited liability company registered in the State of New Mexico, United States, with its registered address at 1209 Mountain Road Pl NE, Albuquerque, NM 87110, Amerika Birleşik Devletleri. 2. The Service

İhaleOn is a business-to-business platform for companies bidding on Turkish public procurement tenders. It collects tender notices and official unit-price data published by public authorities, scores tenders against a company profile, and helps prepare cost estimates, quantity take-offs, progress payments and bid documents.

3. Eligibility and accounts

• The Service is intended for businesses and professionals, not for consumers.
• You must provide accurate registration information and keep it current.
• You are responsible for the security of your credentials and for all activity under your account. Do not share access outside the number of users included in your plan.

4. Subscriptions and billing

The Service is sold on a subscription basis. Prices, included quotas and billing periods are shown on our pricing page before you buy. Subscriptions renew automatically for the same period until cancelled. We may change prices with prior notice; changes take effect at your next renewal.

4.1 Paddle is our Merchant of Record

Our order process is conducted by our online reseller Paddle.com Market Ltd.. Paddle is the Merchant of Record for all our orders: Paddle handles the transaction, issues the invoice, collects and remits applicable sales tax or VAT, and processes refunds. Your purchase contract for the subscription is therefore concluded with Paddle, and Paddle’s Checkout Buyer Terms apply in addition to these terms. 5. Free trial

New accounts include a free trial. No card is required to start it and no charge is made during the trial. If you do not subscribe, access to paid features simply ends when the trial expires.

6. Cancellation and refunds

You can cancel at any time from your account; cancellation takes effect at the end of the current billing period and stops future charges. We also offer a 14-day money-back guarantee on paid subscriptions. The full terms are in our Refund Policy.

7. Acceptable use

• Use the Service only for lawful purposes.
• Do not scrape, bulk-extract, resell or redistribute the Service’s data, and do not attempt to reverse engineer it or gain unauthorised access.
• Do not interfere with the Service’s infrastructure or with other users.

8. Data sources and accuracy

Tender, unit-price and index data are compiled from official public sources, including the Turkish Electronic Public Procurement Platform (EKAP), the Turkish Statistical Institute and the Official Gazette. This information is provided for guidance. We do not control those sources and are not responsible for errors, omissions, delays or changes in them. Cost estimates, bid prices and any resulting commercial decisions remain your responsibility, and you should verify critical figures against the official source before relying on them.

9. Intellectual property

The software, design, brand and our own content are protected by intellectual property rights. We grant you a non-exclusive, non-transferable right to use the Service for the term of your subscription. Content you create in the Service (quantity take-offs, bids, progress payments and similar) remains yours.

10. Warranty disclaimer and liability

The Service is provided “as is” and “as available”, without warranties of any kind to the maximum extent permitted by law. We are not liable for indirect, incidental or consequential damages, or for loss of profit, data or business. Our total aggregate liability is limited to the subscription fees you paid in the twelve months before the event giving rise to the claim. Nothing here limits liability that cannot be limited by law.

11. Suspension and termination

We may suspend or terminate accounts that breach these terms. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.

12. Changes

We may update these terms. We will give reasonable notice of material changes; continuing to use the Service after they take effect means you accept the updated terms.

13. Governing law

These terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict-of-law rules. Mandatory consumer-protection rights available to you in your country of residence are not affected.
